The end of 2013 was filled with a different type of lawsuit than that which typically pours from Mississippi justice courts.
Malpractice suits — which typically give rise to class action settlements in lawsuits that otherwise lack merit — seem to have become the order of the day, and the next 12 months are likely to reflect a steady stream of mass settlement agreements and attorney fee awards.
At least 15 medical malpractice cases have been settled in 2013, at least nine of them involving MassHealth.
Those settlements, along with the decisions by MassHighway and MassPort to cut back on their liability insurance coverage, likely played a role in the cancellation of the state’s two-year old medical malpractice arbitration program. A handful of providers had benefited from that program, providing a venue for injured patients to seek compensation for their injuries against the responsible health care provider. Now only one program exists, and it comes from the federal government.
Massachusetts seems to have lost a golden opportunity to reform its medical malpractice laws.
To be sure, the state appears to have managed to save its medical malpractice system from the chopping block. Lawmakers acted on the recommendations of the State Medical Review Panel, which had found broad agreement among doctors over the need for reform of the state�
